EDUCATIO PUBLIC SERVICE COMPANYS GENERAL CONTRACT TERMS FOR THE REQUISITION OF THE KEMPELEN FARKAS STUDENT INFORMATION CENTERS SERVICES
CHAPTER 1.
DESIGNATION OF SUPPLIER AND REGISTERED MEMBER
1. § Supplier: EDUCATIO Social Supply Public Service Company (hereinafter: Supplier)

Service fulfilling registry unit: Kempelen Farkas Student Information Center (HIK)

2. § Registered member can be - the determined person in the 2005. CXXXIX. Act on higher education (hereinafter: Hea.) 1.§ (higher education institutes students, teachers, science researchers and other persons who are employed in higher education) who possesses valid registration (5.§).
3. § In these General Contract Terms the detailed conditions of requisition of the basic and complementary services - provided by the Supplier for Registered members - are regulated.
CHAPTER 2.
REGISTRATION OF THE REGISERED MEMBER, REGISTRATION FORM, VISITING CARD
4. § During the registration a service contract comes into existence between the Supplier and Registered member in such manner that the Registered member accepts the General Contract Terms and the other rules concerning to other services secured by the Supplier - by signing the Registration Form at Suppliers place during the registration.
5. § Before filling out the Registration Form Supplier secures that the registering person can get acquainted with the General Contract Terms in the registration room or by the HIK intranet.
6. § The precondition of the Registered members registration by the Supplier is that the Registered member should give all his/her information and data - including his/her personal data - which are required for his/her identification and for the requisition of the services by filling out the Registration Form right and showing the Supplier all certain documents required by the Supplier.
a. The student of the higher educational institute should certify his/her registration legal status with the personal student card validated with validation sticker for the given semester made out by the higher educational institute; or with a written declaration which certifies his/her student legal relation without doubt (student legal relationship certify) made out by the higher educational institute.
b. The higher education institutes teachers, science researchers and other persons who are employed in higher education should certify his legal status with an employment contract or with a written declaration which certifies the existence of other legal relationship concerning to working - made out by the higher educational institute.
7. § Registered member becomes authorized from the moment of the registration for one year period for the requisition of the services given by the Supplier after
a. fill the Registration Form in
b. the acceptation of the Form by the Supplier
c. paying the registration price.
Supplier can not dismiss the Registered members registration if the Registered member suits all registration demands and is not closed out of the requisition of the services by Supplier. (43§)
8. § Supplier publishes registration price for the given semester at the registration place and on the http://www.hik.hu website.
9. § After the end of the authorization period determined in the 7. §, Registered member is authorized to lengthen it with another one year in case he suits all registration demands at the time of the lengthening.
10. § The Registered member, who possesses Temporary Card (15. §), after the end of the validity (three months from the start of the possession) cannot prolong it and cannot possess it again. At the same time, the Registered member is authorized to possess a Student Card (13 §) or a Membership Card (14 §) as long as they fill the requirements of the application.
11. § During filling the Registration Form in and the identification, Registered member is obligated to show the following documents for the Supplier:
a. for resident natural person: address - certifying state pass, identification card or passport, for foreign natural person: passport,
b. Registered member obtaining legal status based on the student legal relationship: the determined documents in 7.§,
c. determined in the Hea. 1. § (1). paragraph point b., Registered member obtaining legal status based not on the student legal relationship: documents determined in 7. § b.
The Supplier records the Registered members following data during the identification:
a. natural persons family and last name, in womens case maiden family and last name too,
b. address, post address
c. e-mail address, (as long as the Registered member renders it available)
d. place and date of birth,
e. citizenship,
f. mothers maiden family and last name,
g. type and number of the identification documents,
h. number and type of student card,-
i. the name of the higher educational institute which secures the Registered member status and the type of the relationship (student, teacher etc.),-
j. marking of the higher educational institutes faculty and chair.
The availability of the e-mail address is based on voluntary principle; the Registered member cannot be obliged to give it out to the Supplier.

During the registration the Registered member can assist that HIK will send him newsletters to his previously given e-mail address.
12. § The valid registration is certified with the chip card - based student card took with the HIK sticker (Student card) which is needed for the entrance into Suppliers building. The authorized access to Suppliers computer service is secured by the Supplier who activates the chip card simultaneously with the registration.
13. § The Registered members who do not possess chip card - based student card receive an integrated access and a chip card (Membership Card) during the registration which certifies the act of registration and secures the access into the Suppliers building and computer system for the Registered member.
14. § The Registered members possessing Temporary student card receive Temporary card after registration. The Temporary card is valid for three months from the start of the possession, together only with the document given out during registration. The Registered member is obligated to pay 3.400 HUF deposit price to receive the temporary card which sum will be paid back by the Supplier at the returning of the card.
15. § If Registered member gives the Supplier defective, unreal false or unsatisfying data or gives not the Supplier the needed documents, Supplier is authorized to refuse service until the substitution of the missing or right data.
HANDLING OF PERSONAL DATA, PROTECTING DATA
16. § Supplier is qualified as legal data handler if the Supplier uses personal data during its merchantable operation and during exercising its own rights determined in this General Contract Terms. The data handling according to the 1992. LXIII. Act on publishing common weal data and protecting personal data is qualified also as legal data handling.
17. § Supplier is authorized to control the genuineness of the data given by the Registered member with all available legal devices.
FORCE, SUBMISSION AND ALTERATION OF THE GENERAL CONTRACT TERMS
18. § Supplier promulgates the General Contract Terms for the Registered members at the services place, anybody can inspect it or get acquainted with it during the opening hours. After the registration - which came into existence between Supplier and Registered member - these General Contract Terms are also applicable even if Registered member did not accept these General Contract Terms - but with the fact of registration, Registered member accepts and acknowledges these General Contract Terms as an implied contract.
19. § Supplier is authorized to alter unilateral the General Contract Terms. Supplier informs Registered member about the Registered members restricted rights altered in the General Contract Terms 15 days before the altered text comes into force by posting it up at the services place. Supplier informs Registered members about the non - restrictive alterations at least on the previous working day before the entry into force by posting it up at the services place.
20. § For all legal relations between Supplier and Registered member the altered General Contract Terms are authoritative from the time the alteration comes into force.
21. § If Registered member notices - before the alteration comes into force - to Supplier in written form that he/she does not accept the alteration of the General Contract Terms, both parties are authorized to recall the legal relation between Supplier and Registered member, but this does not affect the Registered members performance of obligation existing to Supplier. In this case the time of recall is - at deficit of distinct contract instructions - 15 days. In these 15 days the instructions of the General Contract Terms before the alteration are authoritative.
22. § If any of these instructions of the General Contract Terms are contrasted with any documents signed by the Supplier or the Registered member connecting to this contract, this documents instructions are authoritative.
NOTICE OF DATA CHANGES
23. § Registered member is obligated to notice the Supplier - in the time period determined in this point - without relay, the changes of relevant circumstances, facts, data which are important to the legal relation including specially the data marked on the Registration Form and the identifying data - according to reality. Registered member is obligated to notice - in 5 working days after it comes to the Registered members knowledge - the changes of data given by Registered member during the registration. Supplier is not responsible for the damage coming from failing the notice.
CHAPTER 3
USING HIK CARDS, GENERAL RULES OF REQUISITION OF SERVICES
24. § The Registered member who does not possess chip card - based student card is authorized to claim a chip card after registration.
a. The person determined in 2. § receives a Membership card if he/she does not possess student card; or possesses a student card but likes to requisition the services with the Membership card.
b. The Registered member, who possesses Temporary student card (15 §), receives a temporary card and will use the services not with membership card.
c. To receive a Temporary card, the Registered member is obliged to present his Temporary student card. The presentation of the written declaration which certifies his student legal status is not acceptable to possess a Temporary card.
25. § Registered member is authorized only with the chip card to requisition Suppliers services connected to the chip card identification.
26. § The chip card given to the Registered member by the Supplier remains Suppliers property.
27. § It is possible to substitute the lost or stolen chip card by a written instance of the Registered member. Registered member is obligated to inform Supplier immediately about the loss, destruction, or damage of the chip card.
28. § Registered member is not authorized to demand the activation of the restrained chip card by the Supplier and Registered member is obligated to deliver Supplier immediately the already restrained chip card.
29. § The chip card is for one person and can not be delivered to another person. The person who registered and took the chip card takes responsibility for the damages caused by the delivering of the chip card.
30. § Temporary card is valid only with the certify given during the registration. The Temporary card certifying form consists the following data:
a. natural persons family and last name, in womens case maiden family and last name too,
b. address, post address and e-mail address,
c. the number of the Temporary card.
31. § The Registered member who defaulted obligations, takes responsibility according to the rules of the Civil Code for every damage - concerning the Supplier or other Registered members in legal relation with the Supplier - caused by his/her default of obligations.
32. § Registered member bears the charges of loosing the chip card and claiming a new chip card.
33. § After the end of the contract Registered member is obligated to handle back the chip card to Supplier in one working day.
34. § Registered member is obligated to use all devices merchantable made available by the Supplier. Registered member takes responsibility according to the rules of the Civil Code for the damages caused for the Supplier. Registered member and Visitor are obligated to observe Suppliers every rule and obligated to requisition services merchantable without disturbing other Registered member.
35. § If Registered member violates copyright law with acquiring, or making available and with the transmitting or publishing or in other ways - in the HIKs system, or with the help of the HIKs system - any kind of data, text, which is under the protection of copyright law, Registered member comes into legal relation directly with the holder of title. According to this, Registered member notices that he is obligated to take responsibility directly and unrestrictedly for the claims validated against the Supplier through this legal title.
36. § Supplier takes responsibility and is responsible - according to the general rules of the civil law - for the damages of the objects taken into the building by the Registered member.
EXTINGUISHMENT OF THE SERVICE CONTRACT
37. § The contract comes to an end:
a. by the cessation without successor of the Supplier,
b. by the death of the Registered member,
c. if Registered member comes out of the force of the He. act,
d. by the cessation of Suppliers service entitlement,
e. by Registered members notice,
f. by Suppliers notice.
38. § Registered member can make prompt notice anytime in written form, without reasons. In case of his/her notice Registered member does not escape from the obligation of paying his/her debt coming from every cause according to the legal relation.
39. § If contract comes to an end because of Suppliers cessation without successor or because of cessation of Suppliers service entitlement, Supplier is obligated to pay back the yearly registration prices proportional part to Registered member.
40. § Supplier is authorized to give an immediately notice only if Registered members behavior is a breach of contract.
41. § A breach of contract is specially if Registered member hinders or endangers Suppliers merchantable operation or if Registered member causes Supplier a damage with purpose or does not keep Suppliers rules concerning to Registered members.
42. § It is also a breach of contract to acquire and to make available - in the HIKs system, or with the help of the HIKs system - any kind of data, text, which is under the protection of copyright law.
CHAPTER 5
SERVICES
43. § Supplier, with the help of its own unit, the Kempelen Farkas Student Information Center supplies services at the 1088 Budapest Reviczky Street 6. real estate.
44. § The services given by the Supplier - not considering the exceptions in these rules - are available Monday to Saturday from 8 am to 10 pm for the authorized person.
45. § The services given by the Supplier are basic and substitutional services. The basic services are for free, except if Supplier establishes payment price - with separate price marking - for certain elements of the basic service. The substitutional services are against for payment, Registered members can requisition them either.
CHAPTER 6
CERTAIN SERVICES
EISZ
(Electronic Information Service)
46. § Supplier secures access to EISZs database for the Registered members.
LIBRARY SERVICE
47. § Supplier makes either paper based books and electronic issues available for Registered members. The traditional library books cover first of all the lecture notes used in higher education, and the fields of certain science divisions. In order to the fact that Registered members can only read the books at the place, the library service does not comprise the library loaning.
48. § The library
a. makes available its stock for HIKs Registered members for local use;
b. secures a searching surface on the computers located in HIKs area and on through the http://www.hik.hu website;
c. secures copying possibility of the stock taking copyright law and stock protecting points of view into consideration;
d. gives information about native and foreign library services based on catalogues, computer databases and outside databases available on the internet.
49. § HIKs library makes possible the documents available in the marked halls in free shelf placing. Maximum 3 books and 1 CD - Rom can be taken from the marked hall to HIKs other rooms with the permission of the librarian serving there. The librarian registers the documents taken out. Chip card is needed for the requisition of HIKs library services.
50. § The documents taken out must be taken back after usage, but at the very latest 15 minutes before closure, and the librarian should register them out of the system.
51. § In case the documents are proven purposely damaged, Registered member takes responsibility according to the rules of the Civil Code.
INTERNET ACCESS
52. § Supplier secures internet access for Registered members. Supplier is authorized to limit the maximal usage of internet occasionally to 3 hours daily.
53. § To download and to secure data access materialized by any kind of behavior which is contrary to the particular part of the Penal Code consequently qualified as crime is prohibited. It is also prohibited to download and to secure materials which harm good taste or are contrary to the good morals or good taste.
USAGE OF COMPUTER
54. § Supplier serves office services (word processing, document making etc.) for Registered members. Supplier is authorized to limit the maximal usage of internet occasionally to 3 hours daily. If Registered member does not use computer and leaves the desk 15 minutes after logging in, Supplier is authorized to free the computer and log the user out.
55. § The user of the internet infrastructure belonging to HIK or in the usage of HIK is obligated to do his/her work according to its function. It is prohibited specially: disturbing other users activity; acquisiting unauthorized entitlement and data; damaging software and hardware elements; endangering their functioning ability. User is obligated to co-operate with the marked operator staff in the interest of their as effective as possible work.
56. § The user is authorized:
a. to ask to secure the resources awarded for him/her,
b. to requisition the services assigned to the computer according to the counting of the user category,
c. to requisition informatical support,
d. to ask for the help of the Informatical Unit in case of failure and malfunction.
57. § The user is obligated:
a. to keep the rules concerning to the users,
b. to execute the operating staffs instructions,
c. to log in to the computer system immediately after arriving to the computer room simultaneously with the occupancy of the seat,
d. to take away his personal items from the desk in case not using the computer more than 15 minutes,
e. to notify important events connected to the usage of the computer,
f. to warm other users to keep the rules; to notify and to hinder the not merchantable usage and the usage opposite the rules,
g. to inform Informatical Unit immediately to shut computer down and to suspend further usage until the arrangements of the Informatical Unit - in case of failure, malfunction and virus infection (or suspicion),
h. to inform the competent operating staff about the possible detected security problems.
58. § It is prohibited for the user:
a. to strip the computers and configurations; to change the hardware configuration settings; to change the monitor or printer; to strip or to restrict network; to connect machines, tools without permission,
b. to disturb other users work; to survey or to copy others materials,
c. to change the computers or the installed softwares settings,
d. to deploy the computer into another room without the permission of the Informatical Unit,
e. to keep on working with the disabled or virus infected computer, to try to avert the failure alone,
f. to acquire resources, services, legitimations, quotes which were not permitted for him/her. The tryout without reference to the success means a breach of contract.
59. § In case of breaching the obligations
a. If user breaches the obligations laid down in the rules culpable - with purpose or with negligence - the leader of the competent area informs the Informatical Unit in written form about the breaching of obligations and their circumstances.
b. HIK can initiate a civil law or (if necessary) penal law call to account contrary to the rule breacher user.
c. HIK can initiate the reimbursement of properly damage coming from the breaching of rule.
d. If user leaves desk without taking his personal items away, operating staff closes away the personal items after 15 minutes in order to that Supplier can serve access to computer for other waiting user. User becomes authorized to access to his personal items after the identification with the card. After closing the rooms, personal items can be received at the HIK customers service - after the identification.
60. § For Registered members Supplier secures the usage of the wireless fidelity (WIFI) of HIK. The Registered member is obligated to fill in a form if brings a notebook in, and is obligated to show it to the security staff when leaving. The Registered member notes, that he can bring the notebook out of the building only after showing the above mentioned form to the security staff.
INFORMATION SERVICE OF THE KEMPELEN FARKAS STUDENT INFORMATION AND RESOURCE CENTER
61. § Supplier runs an informative service in HIKs building. The services associates inform Registered members and Visitors about the requisition possibilities of the services.-
62. § Registered members can ask for reference and instruction connected to the interpretation of the General Contract Terms from the information center.
CUSTOMERS SERVICE OF THE KEMPELEN FARKAS STUDENT INFORMATION AND RESOURCE CENTER
63. § The customers service offers the following services for Registered members: entrance examinational -, higher educational learning -, post gradual training guidance, scholarship mediation - guidance, carrier - guidance, information about student credit possibilities and student preferences, language training guidance and answering other questions connected to higher education.
CHAPTER 7
SUPPLEMENTAL SERVICES
NOTE-, AND TEXTBOOKSTORE, BOOKS
64. § Supplier is authorized to determine discount for the Registered members and for the persons who possess valid student card.
PRINTING, PHOTOCOPYING, CD - WRITING, SCANNING
65. § During the requisition of these services Supplier do not examines if the duplicated documents are under the force of the protection of copyright law or not. In case of violating the copyright law the committer who commits the violation of the copyright law comes into legal relation with the entitled of the copyright law.
CHAPTER 8
STAYING IN THE BUILDING
66. § Registered members and other natural persons receiving accessing right based on other legal relation can stay in HIKs building.
67. § Registered members can stay in HIKs area during the opening hours. 15 minutes before the end of the opening hours HIKs staff warn Registered members to leave the institute.
68. § Cloakroom operates in HIKs area; the usage is for free and obligatory. HIK takes responsibility for the items placed in the cloakroom according to the general rules of the civil law.
69. § Bags with size in excess of 20 X 30 centimeters can not be taken into the teaching, and reading rooms. The person who leaves the area of HIK is obligated to show - on request - his/her bags content.
70. § 4 pieces of printed, personal documents can be taken into the teaching, and reading rooms. The documents that are taken into the rooms must be reported to HIKs staff. Reporting forms are available at registration and at the security desk.
71. § It is prohibited to take food and drink into the teaching and reading rooms.
72. § It is prohibited to drink alcohol and to use drugs in HIKs area. Smoking is only allowed in the assigned places.
73. § The usage of mobile phones in HIKs area are only allowed in the buffet, in the area of the inner yard and in the rooms assigned for the usage.
74. § Personal computer or other computer tool can only be taken with the permission of HIKs director into the teaching, and reading rooms.
CHAPTER 9
FIRE AND OTHER SECURITY RULINGS
75. § Firearms, other weapons and explosives can not be taken into HIKs area.
76. § If HIKs fire service signal system sounds, every person staying in the area of HIK is obligated to leave HKs building immediately according to the rulings of the fire service rules and the evacuation plan.
77. § HIKs staff is authorized to ask persons staying in the area of HIK to show their chip card, student card and - in case of temporary card - the certify needed for the validity.
TERMINAL RULINGS
78. § These General Contract Terms come into force on the day of 1 June 2009.
